In the 2008 rulling in District of Columbia v. Heller the Supreme Court of the United States (SCOTUS) affirmed that the 2nd Amendment Right to Keep and Bear Arms (RKBA) is an individual right. The anti-gun crowd immediately jumped on the decision as only applying to the District of Columbia because of its status as a “federal reserve”, claiming that it is not a state or “normal” incorporated municipality. Hence, in McDonald v. Chicago a “normal” city (Chicago – if you call it normal) which had a blanket ban on handguns was challenged… and beaten. Of course, within a couple hours (or less) the Mayor of Chicago said the city would immediately begin building whatever restrictions it could to keep the citizens safe from “gun violence”. Some people never learn.
In its ruling against Chicago SCOTUS has again made it clear: The 2nd Amendment recognizes Americans’ fundamental right to bear arms; a right that cannot be violated by the federal, any state or local governments. The decision makes me think about the simple phrase pro-gun advocates have so long used: What part of “shall not be infringed” don’t you understand?
The court was divided in its 5-4 vote, predominantly along the traditionally perceived conservative / liberal lines. It was no surprise to anyone, I don’t think, that President Obama’s first Justice appointment, Sonia Sotomayor, voted in favor of gun control and against the rights of We The People. This should be very carefully considered by the Senate as they continue hearings into the confirmation (or not) of Supreme Court nominee Elena Kagan. Kagan’s history of published opinion clearly expresses her anti-1st and anti-2nd Amendment position. I can’t help but wonder what goes through President Obama’s mind as he nominates someone who espouses banning books and denying citizens their 2nd Amendment freedoms.
I thank and congratulate SCOTUS on rendering such a valid decision in McDonald v. Chicago. It will be interesting to see where the 2nd Amendment battle goes from here.
