Federal Immigration Enforcement Failure

In the Washington Times we read this article that describes how our Federal Department of Justice is quite picky about which laws it feels should be enforced and which ones aren’t so important. The article is written specifically to call attention to the irony of the Federal Government filing a lawsuit against the State of Arizona for its Illegal Immigration Enforcement law, all the while totally ignoring the fact that Sanctuary Cities openly offer safe haven and harbor to those who commit felony crimes.

Apparently the Justice Department – the same Justice Department which has chosen not to prosecute members of the New Black Panthers who intimidated and assaulted voters during the last presidential election – has decided that there’s a significant difference between cities who choose not to enforce federal laws and a state that has decided to enforce a law identical to existing federal laws but that the federal government not only doesn’t enforce but now claims are unenforceable.

Now, maybe it’s just me, but if the federal government – by way of Congress – creates laws and authorizes budget allotments to enforce those laws and then completely fails to enforce those laws, wouldn’t you think that same federal government would more than willingly accept assistance from states that have the will, wherewithal and budget to enforce their own such laws?

Statements made by the Obama Administration – specifically from President Obama, Janet Napolitano and Eric Holder – make it obvious that the federal government’s current “leadership” simply don’t have the political will to enforce these laws. The President knows all too well that he and all of his “friends” NEED the Hispanic vote if they hope to survive the mid-term elections much less the next presidential campaign. Standing up and enforcing an existing, budgeted federal immigration law would mean potentially angering a segment of their voting base – and they aren’t willing to do that. Why?

Because they are more interested in keeping the power, money and prestige of their positions than they are in serving the interests of our country and all her citizens!

Now, I fully expect to be called racist because two of the three “leaders” I cited are “African American”. Yeah, sure… President Obama has CHOSEN to embrace claiming “African American” nationality. The man is 50% caucasian (the majority of his ancestry), 25% Kenyan (where many still claim he was born), and 25% Arab (the Muslim faith of which he HAS claimed and admitted). If Eric Holder is 100% African American than I’m a monkey’s uncle. Setting aside me having to defend myself against racial accusations…

I find it unethical, immoral and potentially illegal for elected and/or appointed “leaders” in our country to knowingly and self-servingly choose not to enforce federal laws in the name of protecting re-election chances or reappointment chances. Isn’t this malfeasance of the purist kind?

  1. With the way current laws are, if us officers stop someone for a simple traffic violation, and they have no identification, we question them as to their identity. Doesn’t matter what nationality they are. How can we issue a citation if we don’t know who they are, or where they reside. Majority of those stopped that don’t have their driver’s license, simply ran out of the house and forgot their license. Okay, we deal with it. Though a database search, we confirm their identity by name and DOB, along with physical identifiers like height, weight, eye color, etc. They may not have it because their driving privilege is suspended/revoked. But upon confirming identity, we deal with it by issuing a citation or arrest in compliance with state law. Now if we are unable to confirm their identity, we question the violator further in an attempt to identify them. There are times when we stop someone that has never had a driver’s license and has never been arrested, so we get “No Record Found” when conducting the database search. We continue to question the violator as to where they live, how long, etc, in an attempt to confirm who they say they are. If we suspect that they violator is not a U.S. citizen, who do we go to for further investigation? That would be I.C.E. But here is one of the problems, your in an area that doesn’t have a local I.C.E. office, or they don’t have an I.C.E. agent in the area that can assist, they advise to release the violator. This shouldn’t be happening. Even for the simple traffic violation, why should this potential illegal immigrant get off without a citation, when a U.S. Citizen, that lives and pays taxes here have to pay for a citation that an illegal doesn’t. Local, County and State law enforcement should be able to take the next step in the process with potential illegal immigrants. Those steps are to identify, prosecute and hopefully deport them back to where they came from. Again, let me state that it doesn’t matter what nationality they are, they could be from Iceland, Russia, England, Mexico, where ever, it doesn’t matter if they are here illegally.
    I completely agree with what Arizona is doing with this new law, and the federal government should but out. What are they afraid of? Probably that Arizona law enforcement is going to show them up, and be filling the jails to capacity with illegals. The federal government needs to pull their head out of the sand and realize that illegal immigration is a major issue in Arizona, and other southern states, and becoming a bigger problem throughout the United States.
    As a former resident of Arizona who had to deal with Janet Napolitano as Governor, I had no faith in her then, and have no faith in her now as Secretary of Homeland Security. In my opinion, she is a politician that doesn’t care about anything but continuing her career as a politician.
